The ALL INDIA PRIVATE EDUCATIONAL INSTITUTION ASSOCIATION (AIPEIA) is a pioneer organisation that is unifying and supporting India’s private educational institutions. Shri.B.T.Arasakumar formed the Tamilnadu Tamil and English Schools Association, which eventually became the All India Private Educational Institutions Association. Previously, Shri.B.T.Arasakumar was the State Organiser of the Nursery and Middle Schools Association. AIPEIA has been serving and supporting private educational institutions since last 30 years.

The fundamental necessity

Yet again, all schools must be united under one roof, with the correct governing head having profound experience on the academic aspect, political narrative, legal aspect, official contacts, and in-depth knowledge on GOs and verdicts against institutions throughout India.

The capabilities of our founder are well known. His efforts have been fruitful that AIPEIA now proudly holds the most private educational institutes of several sectors.

The institutions governed by various Government bodies classified as below:

AIPEIA was formed with the goal of protecting the interests of private educational institutions ranging from matriculation schools to colleges. It fought for the various rights of the institutions with the assistance of senior legal expert counsel, approached courts of law from sessions to the Supreme Court of India, and obtained orders favouring the association’s members.

Hereby, we take pride in sharing a few of the many accomplishments of AIPEIA.

Permanent Recognition

Prior to the Kumbakonam incident, the Government was granted permanent recognition which was revoked after the mishap. We, along with a group of institutions, petitioned the Honourable High Court of Judicature at Madras in WP.No. 5868 for permanent recognition of AIPEIA members. Following our senior counsel’s argument, the high court directed the government to consider our petition within six weeks.

Establishing Parallel CBSE

In accordance with the 1974 Tamil Nadu Recognized Private School (Regulation) Rules and the code of regulation for Matriculation Schools, Tamil Nadu recognises the opening of a Parallel CBSE Board Institution on the Same Campus. Obtained court orders on W.P.No.10208 from the high court judicature at Madras and urged the state and central board to decide.

DTCP Approval

The Tamilnadu government ordered the institutions to get the DTCP permission in its GO Ms. No. 76 of June 14, 2018, despite the fact that the institutions had already received local body approval for recognition. For the schools that built buildings before 01.01.2011, AIPEA filed a writ  vide under no. 17178 of 2018 and won the case, which resulted in an order quashing the G.O. on 10.12.2018. A writ appeal was filed against the court’s order exempting schools that built the structure after receiving local authority approval without specifying a date in W.A. No. 233 on January 3, 2019, and it was successful in obtaining a stay of the judgement.
The Tamil Nadu Government issued letter No. 1818/MS/2018 on June 25, 2018, instructing the whole educational department to compel colleges to submit applications for concurrence. On October 28, 2022, the AIPEIA once more objected to the same and received an order in WP No. 24909.

Property Tax

The government mandated that property taxes be paid. AIPEIA filed a writ appeal vide under number 45768, contesting the high court’s ruling in the government’s favour. The Supreme Court accepted the petition once our appeal was filed there.

ESI for Educational Institutions

AIPEIA requested a stay of the ESI contribution process from the court in WP No. 3423/2019, citing the Supreme Court’s notification dated 02.01.2017 that the case would be transferred from 7 judges to 9 judges because the employees were unwilling to have the ESI contribution deducted from their pay. We are one of the respondents in the lawsuit currently before the Supreme Court.

Collection of fees during a pandemic

When the government was wavering between positions regarding collecting fees from students during the pandemic, AIPEIA approached the court through a team of experienced senior counsel and was granted an order to begin collecting 80% of the fees on July 30, 2021, in WP 8790.

Releasing of SC/ST scholarships within the academic year

AIPEIA requested the court to release the arrears scholarship funds for the 2019–2020 school year via WP No. 10184/2020, and we were successful in getting this request granted. The court instructed to release the order until 2020 and was further told to issue it during that academic year.

Plan of Action

According to government policy, all employees must be enrolled in the PF programme. While most employees are uninterested, the majority of educational institutions are covering employee contributions on their own. However, there are not many instances of employees claiming their money back. We are in the process of gathering information on the PF, and we’ll shortly take legal action to put an end to it.

Right to Education (RTE)

Admission of 25% of students under the Right to Education (RTE) Act is mandatory for self-financing institutions. The fact that government recognition only entitles recipients to perks like reduced tuition costs rather than benefits like free books and uniforms is troubling. It is also regrettable that some parents might abuse the RTE Act, thus adding to the financial strain on self-financing institutions. Making sure that the RTE Act is applied fairly and without undue financial burden on private educational institutions is crucial.

The effects of such a choice on pupils who might benefit from the programme should be considered when deciding whether or not to end the requirement for RTE in schools. At the same time, allowing interested institutions to accept RTE students might be a way to support schools financially while also ensuring that poor kids have access to education.

Insurance

Insurance charges significantly impact the profit and loss of institutions. Each school is responsible for covering the costs of its buildings, possessions, personnel, students, and vehicles with insurance. We’re attempting to work out a 30% discount for all of our members with the insurance provider. Only with our unity and a single insurance check can this be possible.

Fees Determination Committee

The Fees Determination Committee‘s fee fixation is always significantly less. It is not fixed as per the School category. The Committee deliberately refuse to accept all expenses done by the School management.

Even Collecting fees from the parents of rural schools is so difficult. Most Schools suffer a lot, and it’s sorry to say that managing schools nowadays is very difficult and stressful. If the committee’s fee recommendations are not favourable for us, the legal team of our Association will take it to court.

Office bearers’ elections

The association’s regulations must be adhered to, and elections must be held every three years to elect new representatives in office at the state, region, and district levels. Yet, because of COVID-19 pandemic, numerous organisations and groups, like AIPEIA, have encountered difficulties in conducting elections as part of their routine activities. But, the moment has come to elect new officials for the district, region, and state levels for the school year 2023–24, as per associational guidelines.
